The appeal of court decisions at the European Court of Human Rights

Having passed all the judicial instances of his country and not having received the satisfaction of legal requirements, each person can apply to the European Court of Human Rights. The court is located in Strasbourg and is examining complaints of violations of human rights. This court makes decisions that are binding on the participating states, one of which is Ukraine.

The Ukrainian judiciary, in all instances, puts literal interpretation of the articles of laws in the first place or happens to be biased for other reasons. Therefore they often make formal and illegal decisions, which, of course, does not satisfy the injured party.

Unlike Ukraine, the protection of human rights in the European Court of Human Rights is considered the most crucial principle that excludes the possibility of ignoring violated rights. For this reason, applying to the ECHR with a complaint is very likely to resume your violated rights and resume justice with Ukraine’s obligation to pay reasonable satisfaction.
